There are three books on labor arbitration advocacy that belong in every labor relations professional's personal library, (by the term "labor relations professional," I mean not only employer representatives, but employee and union representatives):1) "How Arbitration Works," by Frank and Edna Elkouri, (often referred to as "Elkouri and Elkouri"), edited by Alan Ruben, et al;2) "How to Prepare and Present a Labor Arbitration Case: Strategy and Tactics for Advocates," by Charles Loughran; and,3) "Fairweather's Practice and Procedure in Labor Arbitration," by Owen Fairweather, (usually referred to as "Fairweather"), edited by Roy Schoonhoven, et al.These three volumes, even if purchased used, represent an investment of upwards of $500! But if you are serious about your craft, and the interests of the people, company or union that you represent, you'll make the investment - particularly if you are "practicing" without the benefit of a law degree. It takes God given talent to be an outstanding arbitration advocate - but anybody can be competent. As Irving Younger once observed, (he was speaking to trial lawyers, but it works just as well for arbitration advocates), all anybody really wants is competency. And all it takes to be competent is two things: education and experience. Anybody, including you and me, (well, you've probably got talent, but me, I can use all the help I can get), can get these. As far as education is concerned, you can spend 50 grand, (or more), going to law school - or you can invest in Fairweather, Elkouri and Elkouri and Mr Loughran's volume. As for experience, 25 hearings ought to do it, (or 20 hearings, plus one that blows up in your face - you'll learn a lot more from a disaster than a bunch of winners).Fairweather is a complete arbitration advocay course in one volume. It covers everything from the source of law in arbitration, to arbitration case preparation, to case presentation, to post hearing protocols. It is written in a clear and and straight forward manner - it can be easily understood by the practicing "lay" professional - but it has not been dumbed down - a lawyer will find much of value in it. It is not as "tecnical" as Elkouri and Elkouri is, but it is authoritative enough so that arbitrators will take "judicial note" of it, if they are asked to do so. Without further ado, Fairweather covers:1) Source of law in arbitration;2) Submission of a case to arbitration;3) Suits to compel arbitration;4) Selection of the arbitrator or the board;5) Arbitrability challenges before the arbitrato;6) Obtaining the evidence;7) The hearing;8) The witnesses;9) Contract interpretation;10) The burden of proof;11) Standard of review;12) Rules of evidence;13) Due process considerations;14) Polygraphy in arbitration;15) Remedies;16) Posthearing procedures;17) The award;18) vacation, enforcement or correction;19) Arbitration and the enforcement of statutory rights;20) Fair representation obligations; and21) Arbitration in the non-collective-bargaining setting.Bottom Line: Fairweather is an expensive volume. But if you are in the business of arbitration advocacy, you can't afford not to have it.[A personal note: I am not a lawyer. However, I have more than 40 years of labor relations experience - 10 years as a union representative and 30+ years as an employer rep. I have advocated more than 250 arbitration cases. As someone once observed, I've been around the block.]
These are the best of the best labor lawyers. This book should be assigned in every law school in the united states!!!
